Escort radar use in the day of laser traps
#21

I'd go 100 to the toll, pull over and have a smoke for 5 minutes, pricks.

I got pulled over and had my Cobra on - I keep it up high, right above the rear view mirror. I figure that's the best location to detect signals. I left it on because I didn't want to give the officer cause for alarm if he saw me reaching around the car. Anyhow, I knew I wasn't speeding, and when he came to the driver's door, I had my hands already out the window. He said thanks for the courtesy - I asked him if I could turn off the radar detector, which was now full on because he had not shut down his radar. (Most of the police around here run the radar constantly, so I always know where they are). He said sure no problem. He did not seem the least bit phased by my detector, wailing away like an EKG on a dead man.

Turns out I had a right rear brake light out - I apologized for that -I had been in Philly and drove over some cobblestone streets in the Old City. That must be what did it, just shook the bulb loose, I told him. I had a spare in the glove box and showed it to him. That was that.

The Cobra unit I have has picked up laser, from about 1/16 of a mile ahead, where I was lased from an overpass. At the time I was on the NJ PKE doing 5 over, so I didn't even lift. No warning - if you get lased, it is what it is.

The day I get a ticket by toll plaza calculations, that's the day I stop using the toll road, or just pull over right before the plaza and read another chapter in The Rise and Fall of the Roman Empire. I figure that that's a big reason they don't try it - so many people to stop using the toll roads that it would cost millions or more in lost revenue.

There is also be a potential proof problem if you have a passenger. They have to prove beyond a reasonable doubt that you were driving while the car was speeding. If there was anywhere you could have pulled over, you might have quickly switched drivers along the route. This creates a "reasonable doubt", especially if your trip on the toll road was s long one.

Also in California, due to the speed trap laws, radar tickets are often easy to beat ... if you know what you're doing.

the big variable being the judge - they can choose to listen to your argument, or not

California law requires that, on most non-freeway roads, using radar is per se a speed trap unless there is a traffic survey done within a certain period of time that conforms with certain requirements. I've yet to see the survey that is valid. One of the requirements is that the survey must contain a description of hazardous conditions not readily apparent to the driver. I've never seen one that contains this required section. As a result, the survey is invalid and the officer's testimony is deemed inadmissible. I've won many a radar ticket case for myself and friends. Often, once the traffic commissioner (rarely a real judge) realizes what I doing, he or she finds a way to pass my case to the end of the calendar so that others in the courtroom don't learn from me and make the same argument. If anyone here wants to fight a radar ticket in California, get in touch with me and I'll be glad to walk you through preparing your case. No charge for people who possess the obviously excellent taste to drive a 968!

Captain Trips - Jerry Garcia's nickname from the first Grateful Dead album. (Yes, it's true. You all have an inveterate deadhead amongst you - though I'll bet I'm not the only one. We are everywhere!)
