I tried to post the link to this story and photos in today,s Yahoo headlines several times but for some reason the link does not seem to work , however youbcan just enter in any search engine : " Porsche stuck in wet cement " and enjoy the story to follow.

Whats going to be on that repair bill? Tires, wheels, rotors, axles, bushings, control arms, exhaust ??? Man he must be kicking himself right now.

With the death of the actor who recently died in a 911 GT3 the are comments being made that this car even though it has passed the DMV standards and is legal to be driven on the street, it is basically a race car, not a street car. In the accident the car literally came apart absorbing the crash. Unfortunately the actor died in the crash, which the cops say speed was a factor. Will Porsche be held responsible for the crash? Will this accident become a limiting factor of all cars that are sold as street legal vehicles, but can do 200 mph become a thing of the past?

Porsche settled a lawsuit filed as a result of another GT crash which also ended in two deaths . The sum was not disclosed but reported unofficially at $ 3 mil. Petty cash for Porsche, merely a rounding error, so doubtful that had anything to do with ending the production of the GT was was speculated to be the cause. However, I understand that's the only Porsche produced without the stability system which has been a part of all of their top end performance cars since..it's in the new Spyder alongside a ton of other safety systems. There was another news story recently indicating approx 25% of all Carrera GTs sold have been totaled. I find that a bit hard to believe, but on the other hand , given the price of the parts for that car where a 10 mph rear end collision can cause over $ 100 K damage, maybe that's not so far fetched. Still.. One out of every four ? Yikes. Talk about owners with more money than brains. I'm surprised we have not heard of any major injuries or deaths related to Veyrons. 1,000 HP and nearly the acceleration of a F1, in the hands of wealthy owners who can't handle that kind of power and nothing ? Maybe the car is bulletproof .

The 996 GT2 didn't have traction control either, and I understand a lot of those were wrecked too. I'm guessing you'd find similar stories about the last of the muscle cars from the late sixties and early seventies. Remember the original 930 was known as the doctor killer for it's pronounced trailing throttle oversteer and on off switch boosting.



Regardless, I for the life of me, can't comprehend why Porsche is liable for the actions of those driving a car they produced. If it were a design flaw, I would be more inclined to see the point. Let's see a lightweight car with 620 horsepower...Yeah, I'll just go out and push it to the limits on the street, good plan. Where is personal responsibility? I believe the case mentioned was after an incident on a RACETRACK. I'm even less inclined to place liability on the manufacturer for an on track incident. While the Walker crash was sad, they were very likely going too fast on a public road. Will there be a lawsuit naming Porsche? Likely. Why is anyone other than the persons involved in the crash responsible in this case? I can't figure it.

In this case, if you would try to sue a manufacturer they would destroy you in court, you would not stand a chance.



Maybe in the States it would be possible to win (I heard people over there are sueing each other for pretty much everything?) but that would be too crazy for words, certainly if a racetrack is involved.

If you want to attend a trackday here, you are obliged to sign a paper wich says that you, and you alone, are responsible for any damage to yourself and/or your vehicle.

This is a country full of "victims" ; taking responsibility for one's actions and the consequences of such is not a feasible argument, there has to be a way to blame someone else for it. Hell there have been cases where jury awards were given to people who were hurt while in the process of committing a crime. I believe most of those cases have eventually been overturned on appeal, but the concept that such a claim even finds its way into a court, that there are attorneys representing the perpetrator ( ahem, I mean victim ) is absurd, so suing a car manufacturer for not just a defect but for not doing enough to absulotely guarantee the safety and quiet enjoyment of a 90 year old man driving their 600 HP car is cause for action, or at least sufficiently to make some money settling the claim because the mfg just does not have the desire to spend the time and costs of mounting a defense. That's why there are warnings printed on windshield sun shields which read : do not drive with the shield in place " . Everything has to be idiot-proof.

My mom drove an imported car once, a Pontiac Sunbird. I remember the warnings, they were everywhere. Even on the door mirrors, but you would know those off course.

Can't sign away negligence. Besides, when 47 percent of people are on the dole, lots of folks are incentivized to grab their brass ring and with an over supply of lawyers well. Everybody has to make a living!

I'm a big fan of tort reform. Seems to me the lawyers bringing the frivolous suits should be liable for all costs.
