You're unfortunately correct. America is in a sad state. Wanting to uphold your Constitutional rights is considered crazy, and demanding a balanced budget is akin to being "on the fringe".

About the speed traps: apparently two pics are taken when the road has two or more lanes in the same direction. That way they can verify which of the cars in the pic was speeding.

Funny fact: Gatso, the company that started it all was founded by a rallydriver.

Utah is also a great place to stretch out your legs a bit. On the way to Parade last year, we were able to cruise at over 110mph for miles and miles and miles. Not quite Germany fun, but fun nonetheless.

was just reading today that California courts will throw out photo tickets unless the technician who analyzed the photo is there in person to testify ( an affidavit is not sufficient ) of course you have to request that when you challenge the ticket, can't expect the judge will give you a freebie out of the goodness of his/her heart <img src="/forum/images/smilies/968/glare.gif" class="smilie" alt="" />

california traffic court is a tricky place. the "judges" there are often just lawyers. what you can and cannot do is frequently subject to their whim. if you represent yourself, you will have a much harder time beating the ticket. you really have to know the way the court works, and to what you are legally entitled. knowing what to ask, to elicit the desired response, is key. unlike criminal court, the underlying presumption is that the expert testimony (the officer or camera) is assumed to be accurate, and already given. you need to provide new evidence (not "your side of the story") that either contradicts that evidence already given, or legal reasoning disqualifying that evidence.



as for "throwing out" the evidence from a camera, to clarify, the court CAN do that, but is not required to do that. it is up to the defense to subpoena that technician in advance, as a part of discovery. if you simply show up and request it at the time of your appearance, it will be denied, and the evidence will stand, unless you can get the matter put over for another future date.



it really comes down to how much time, money, and effort you are willing to spend to beat the ticket.

Yup. Also, at the end of the day judges are part of the revenue collecting machine, so you have to make a very compelling case for them to let you off the hook.

it can be done though. i've beaten 17 of the 23 tickets i've taken to court, all without representation. but, i did my homework in advance, including but not limited to finding out when an officer was going to be on vacation, and scheduling the court date for that time.

To the person behind me on Hwy 101 today : There is no reason to tailgate someone who is driving in the slow lane, especially since I was driving about 35 mph over the speed limit. And by the way, those flashing lights on top of your car look ridiculous !

hey a few month ago I took a trip from Tigard Oregon to Dayton Iowa and back, first along rout 80 going East and then came back on 90 going West. It really did not matter what the posted limit was as everyone and I mean everyone was doing at least 85, At one point I looked down at my speedo in a Kia Sedona Minivan and I was doing 108. Yes that was not a typo, 108 and just passed two County Mounties sitting in the middle having lunch which is why I looked down at the speedo in the first place. I slowed the Kia down a bit as that even frighten me. <img src="/forum/images/smilies/968/whine.gif" class="smilie" alt="" />
