seriously though - they've been nailing people left and right around here - in addition to the escalating ticket, some are also getting a citation for distraction (another $150 for the first offense) - some insurance companies are saying they are also counting it as a "point" and jacking your rates



a little quick math, and if i got one, it could cost me well over $1000 for the first offense

1. I have seen a surprising number of people still holding the phone.

2. Note: It is legal to hold the phone, and look down at it, when you are dialing, but you cannot hold it while talking!

The problem, of course, is that hands-free doesn't cure the problem. The only thing that does is a driver with enough intelligence to know what should, and should not, be done while driving. The "hands free" laws will simply be another revenue-raising tool, doing nothing to reduce accidents.



I think it's time to get back to something easier - global warming, here I come.

Great vid.

You can get a whole lot done when driving with your legs.

Having mastered driving with my legs prior to the law I have no problem now doing it.

Now it's even easier to text while driving. <img src="/forum/images/smilies/968/tongue.gif" class="smilie" alt="" />

I thought so as well, but one of the local news stations which had a brief cover story on the new law, reported that's absolutely not the case, in spite of common belief that it may be ! Simply, no hands on that phone for any reason while you're driving, except for making emergency calls , and only if your bluetooth does not function at the time.

I presume that means strictly 911 calls , not "my wife called and told me to buy some milk, and it'll be an emergency if I get home without it.. <img src="/forum/images/smilies/968/wink.gif" class="smilie" alt="" /> " calls.. And texting - most certainly NOT allowed, according to the local NBC affiliate.



As for observing how many people comply with the new law, I'm amazed : even the day before it seemed at least 1 of 3 drivers were holding a phone up to their ear everywhere I looked. I have not seen a single one since the law took effect ! It may very well be that the word got around that $ 20 fine they talk about , is in reality more like Bob said - $ 1,000 when all's said and done.. <img src="/forum/images/smilies/968/mad.gif" class="smilie" alt="" />



Perfectly OK with me though, my car ( the MBZ, not the 968 ) was totaled by a driver who had his phone glued to his ear at the time and no clue what was going on in front of his car, or around him for that matter, so do I think this law will reduce the number of accidents ?! AbsoF***in'lutely !

and actually, no, it's not legal to hold it while dialing - but, it spills over to the distraction section of the code (which i am for some reason finding a heck of a time finding) and is not specifically covered under the 2 new laws



while i agree that the new laws aren't the ultimate solution, it is a step in the right direction - i do see fewer people on the phone now, and having spoken to a number of the most egregious violators (housewives, who generally don't drive well to begin with) they spend less time on the phone while in the car, because they find the interface and gadgets too much trouble



i am hoping this is a trend

Using a bluetooth device with voice activated dialing is the way to go. Now if we could just get the State to go after drivers who:



drink coffee

eat

scream at their misbehaving kids in the back seat

listen to music with their I-pod ear buds in place

put on make-up

put in their contact lens



while driving. Things would be much better.

Whoa, sorry, I thought...., I was wrong, thought I read it somewhere.



But I did look this one up: "Text-messaging is not specifically banned for adults, but the California Highway Patrol said they can be cited for negligence under existing laws. " State's hands-free cell law for drivers in effect

In the UK they are looking a the whole cell talking issue.. and the holding of the phone is really not the problem, if it was, 1 armed people would not be allowed to drive...its the concentration needed to talk that causes the distraction. Most cell calls are not the same as idle banter to the other occupants of the car, but are 'deeper' conversations, thus changing the thought process of the driver to focus on the topic at hand and the brain looses its focus on the surroundings. I will not be surprised if talking on a cell phone in genral while drive will be banned in the near furture...



Think about it... how often have you been in a conversion with the office and after a 10 minute call, you cannot recall any part of that journey.. handsfree or not <img src="/forum/images/smilies/968/smile.gif" class="smilie" alt="" />

one can only hope that common sense will eventually win out, and it will be banned completely

Make automatic trannys and cup holders illegal.

on my way to work today I spotted a quickly approaching ( guessing 90mph + ) M3 drifting over his lane into the adjacent one a couple of times.. as he got closer but still behind, I noticed he was holding a phone to his ear and thought : no wonder he can't keep the car on a straight line, what a jerk..he'll hit someone eventually..



however, as he went by me ( yes, I was in the mercedes, i'd never let a bmw pass me otherwise <img src="/forum/images/smilies/968/wink.gif" class="smilie" alt="" /> ) I realized

he was shaving, while glancing constantly at his visor mirror ! WTF ?! How do you NOT have 3 minutes to shave BEFORE you get into your car ?!



may have been safer if he was on a phone <img src="/forum/images/smilies/968/blink.gif" class="smilie" alt="" />
