yup - always best to leave such things alone if you can. barring obviously reckless behavior (racing or any other such common and/or governed activity does not fall into that category), they have no power to enforce anything like that without a contract, and it is not in your best interests to bring it up. no matter what you do, you would have to give up something. the contract would limit what you had to give up, but is still a compromise of your freedoms.
