Comment of Petticrew WARNING

Dick Petticrew has sent an E-MAil to 968 Register members that his DISASSOCIATING himself and the Regsiter from the upcoming 968 Celebration in Newton. His rationale is that 1) it is not a PCA sponsored event and 2) there is no insurance coverage. As Co-Chairman of last year's celebration we did not have any PCA sanctioningor insurance. The local club was informed of the event and asked if they wanted to participate. They declined because it interfered with the Parade. They were happy to post the event in their calender. I also advertized in PANO and had no objections. I did get some flak from a PCA officer for being so close to the Parade. There has been a "loose" association with the Central PA region when it was held in conjunction with the Swap Meet but it was not an "official" event. Secondly, the insurance thing. We had no insurance for last year's event and there was none for the past 5 Celebration in Hershey. I am sure that everyone's personal insurance would cover any incidents that might occur. I think that Pete and Jay had thoughts that they should let everyone know that they are not liable.

I would not think the attendees would do such a thing but with Pete being in business it was a precaution that seemed necessary. So 968 Register members disregard this WARNING and come to Newton. It's a great event. Don let this this misinformed communique dissuade you.

liability is pretty easy to define when it comes to stuff like this



if somebody is taking money from a group (fees, etc) then they bear liability



if you use a manufacturer's name, likeness, or other associative representation, as an integral part of advertisement or marketing of the event, there is an assumed associative liability on the part of said party



but, it all really comes down to loss - what are the risks? what are the potential losses associated?



i'm sure pete has a general liability policy covering his facility, so the reception is a non-issue



the location of the dinner would be a similar situation as well



the real risk factor is associated with drives - this is the same thing tracks have to go through, and the same thing PCA has to go through - they both have to carry specific insurance policies AND still have to get general liability waivers



to alleviate this issue, do not advertise a drive or fun run or anything like it - if everybody gets together and spontaneously decides to go on a drive, that's one thing - if there is a pre-planned course, schedule, and such, then it is an event, and technically needs an insurance policy held by the organizer



it's a real pain in the ass, started by somebody that just couldn't take their lumps, and decided to sue an event organizer, thereby ruining it for the rest of us



i agree - don't let any of this disuade you

Hey Guys,



To clear the air:



The 2002 thru 2004 two day 968 Celebration at Hershey events, in conjunction with the Central Pa Swap Meet, were officially sanctioned by PCA and we received Significant Interest Group Awards ($300), which went to awards. My 2001 event was 12 968s parked in the Concours with a group lunch and we had Region support but no SIG award. The Region and Area PCA officers attended our events and we always had good turnout (did not reach my goal of 100 but hey I am over it).



Cosimo and Jay both decided, for whatever reasons, that they did not want to have their event in conjunction with their PCA Region. Dick Petticrew and I would have preferred otherwise - BUT - that is their decision as Event Organizors and I respect it.



My wife Elke and I will be at the 968 Celebration - Newtown event in May <img src="/forum/images/smilies/968/wink.gif" class="smilie" alt="" /> with our garage queen red 968 coupe (11,600 miles). Hope to see all of you there - do not forget to bring your 968 memorabilia to share (not permanently) with the other owners.
